User Registration. User Account.
In order to use some of the Service's functions, the User must complete the registration procedure, as a result of which a unique account will be created for the User. A User who has reached the age of 16 has the right to independently register an account and use the Service within the limits of legal capacity established by applicable law. If the User has not reached the specified age, as well as in cases where this is required by applicable law, the use of the Service is permitted only with the consent of parents or other legal representatives.
To register, the User undertakes to provide accurate and complete information about themselves in response to questions asked in the registration form, and to keep this information up to date. If the User provides incorrect information or Blogstars has reason to believe that the information provided by the User is incomplete or inaccurate, Blogstars has the right, at its sole discretion, to block or delete the User's account, or to refuse the User use of the Service or its individual functions.
When registering, the User can upload an Avatar and also set up a User Name.

Account verification.
Blogstars reserves the right to request at any time from the User confirmation of the data specified during registration in the User account, as well as other information related to the use of the Service, available to the User after authorization using the User's Login and password on the Service. This confirmation can also be carried out through a request for identity verification by the User, as well as with the involvement of third parties who help Blogstars ensure the functioning and support of the Service.
Means of access to the User account.
When registering, the User independently chooses a Login and password to access the account. Blogstars has the right to prohibit the use of certain logins, as well as set requirements for the login and password (length, acceptable characters, etc.).
The User has the right to use an alternative means of authorization, chosen by him from the options offered in the authorization form, including using accounts of third-party resources. By choosing an alternative means of authorization, the User agrees to receive data about the User from third-party information resources under the terms of the Privacy Policy.
In order to ensure the security of User data (or categories of Users), Blogstars has the right to establish additional account security measures, including mandatory authorization using the User's phone number specified in the account, requesting additional information and restricting access to the account if suspicious activity is detected in relation to it.
The User is solely responsible for the security (including resistance to guessing) of the means of access to the account / authorization chosen by him/her, and also independently ensures their confidentiality. The User is solely responsible for all actions (and their consequences) within the Service under the User account, including cases of voluntary transfer by the User of data for access to the User account to third parties under any conditions (including under contracts or agreements). In this case, all actions within the Service under the User's account are considered to be performed by the User himself, except for cases when the User, in the manner prescribed by the Terms, has notified Blogstars of unauthorized access to the Service using the User's account and/or of any violation (suspected violation) of the confidentiality of his means of access to the account (mobile phone number, password or two-factor authentication means).
Blogstars has the right, at its sole discretion, to block or delete the User's account or restrict the User's access to the Service (or to certain functions of the Service) in the event of repeated violation of the Terms, or to apply other measures to the User in order to comply with the requirements of applicable law or the rights and legitimate interests of third parties.
Use of the Service and its individual functions
The User may not reproduce, repeat, copy, sell, resell, or use for any commercial purposes any parts of the Service (including Content available to the User through the Service), or access them, except when the User has received such permission from Blogstars or when this is expressly provided for in the Terms.
The links displayed by the Service lead to web pages or sites on the Internet created by third parties. Blogstars does not bear any responsibility for the quality of such web pages or sites, as well as for the content posted on such web pages or sites. Blogstars is also not responsible for the presence/absence, content, and quality of any offers for the provision of services, purchase of goods, etc., which may be available to the User on third-party websites, as well as for any kind of damages that the User may incur by using such offers.
The Service provides the authorized User with the ability to view and customize the User's Public Profile.
The User is notified and agrees that the information posted by him/her in the Service, including information published in the User's Public Profile, becomes available to an unlimited number of persons solely for the purposes of providing the Service and personalizing Users. The information published by the User (including personal data) is not intended for its collection and further distribution by third parties.
The Service provides the authorized User with the functionality to post, distribute, as well as edit and delete Content posted on the Service on his/her behalf. The User is solely responsible to third parties for his/her actions related to the posting and distribution of Content on the Service, including the fact that the content of the Content complies with the requirements of applicable law and does not violate the rights and legitimate interests of third parties. The User undertakes to settle all claims of third parties related to the posting (editing) of Content independently and at his/her own expense. In the event of a dispute, the burden of proof that the Content posted by the User does not violate anyone's rights lies with such User.
The User acknowledges and agrees that Blogstars may review the Content posted by the User on the Service. The User also agrees that Blogstars has the right to refuse the User the posting and/or distribution of Content, or to restrict access to such Content if it is found to be inconsistent with the Terms, including as a result of receiving complaints from Users or notifications from any authorized body that the Content violates / may violate applicable law and/or the rights and legitimate interests of third parties. Blogstars applies a set of measures to prevent and suppress the facts of illegal posting of User information that violates applicable law, including by:
Including in the Terms a warning about the inadmissibility of distributing Content on the Service in violation of applicable law;
Processing complaints from Users, authorized bodies and other persons regarding Content posted in the Service in violation of applicable law. Such complaints may be received, among other things, through special forms for submitting requests, using the "Report a publication" button (or another similar one in meaning), by contacting the support service or in writing to the Blogstars address specified in the Terms;
Using technologies and algorithms that allow you to identify, block and / or delete Content that violates applicable law and / or the Terms.
When using the Service, the User may not post or distribute, among other things, the following Content:
That is illegal, harmful, slanderous, deliberately misleading, offensive to morality, demonstrating (or being propaganda) of violence and cruelty, promoting hatred and/or discrimination against people on racial, ethnic, sexual, religious, social grounds, containing obscene language, insults against any persons or organizations, containing public calls to commit terrorist activities or publicly justifying terrorism, or other materials of an extremist nature, containing elements of (or being propaganda of) pornography, child erotica, representing advertising (or being propaganda) of services of a sexual nature (including under the guise of other services), explaining the procedure for the manufacture, use or other use of narcotic substances or their analogues, explosives or other weapons;
Violating copyrights, trademark rights, means of individualization and/or rights to other intellectual property objects belonging to third parties;
Misleading Service Users regarding the ownership of published User information and/or the User account by Blogstars and/or the Service administration, including by using trademarks and logos belonging to Blogstars, as well as using the designations "Blogstars";
Containing spam (including search), lists of other people's email addresses, pyramid schemes, multi-level (network) marketing (MLM), Internet earnings systems and email businesses, "chain letters";
Containing illegally obtained information about third parties;
Violating the requirements of advertising legislation and/or competition protection legislation;
Containing computer viruses or other computer codes, files or programs designed to disrupt, modify, block, destroy or limit the functionality of any computer or telecommunications equipment, or containing programs for unauthorized access, as well as serial numbers for commercial software products and programs for generating them, logins, passwords and other means for obtaining unauthorized access to the Service, as well as to paid resources on the Internet;
By posting Content on the Service, the User automatically grants Blogstars a free, unconditional and irrevocable non-exclusive license to use the Content, in whole or in part (including the separate use of the audio track of an audiovisual work), throughout the world for the period of posting the Content on the Service at the discretion of Blogstars, including, but not limited to, reproducing, copying, selecting, systematizing, transforming, changing, editing, translating and otherwise processing, publishing, distributing the Content by any legal means, making it available to the public. In addition, the User grants Blogstars the right to use the Content for posting on the Blogstars Resources. Also, by posting Content on the Service, the User confirms that he/she has the appropriate rights and authority to grant Blogstars the specified rights to use the posted Content, including posting the Content on the Blogstars Resources. The User agrees that the posted Content may be used by Blogstars in advertising or marketing materials posted on the Service and/or on Blogstars Resources. Blogstars has the right to use the Content both with and without the User Name - the author of the Content. Blogstars has the right to transfer the rights specified in this paragraph to third parties. If the User does not have the right to grant Blogstars the right to use any materials in the Content in the specified ways, he/she is obliged to refrain from posting such materials on the Service.
The User agrees that Blogstars has the right to use the functional and technical capabilities of the Service that ensure the display of the posted Content, including display through a player, at its own discretion, including for the purpose of displaying advertising information. By posting Content on the Service that is displayed using the functionality of the Service, the User agrees that the tools of the Service allow Blogstars and/or third parties to display the player and/or other mechanisms for displaying Content from the Service on Blogstars Resources, websites and/or platforms of third parties using embedding technologies, built-in frames or other similar technologies. Content management can be carried out by contacting the Service support.
When posting advertising information in the Content, the User undertakes to:
Indicate the advertising nature of such information in the manner determined by Blogstars, or by specifically designating such information in any way accessible to the User as advertising;
Bear full responsibility for compliance with advertising legislation, including, but not limited to, independently complying with the requirements provided for in paragraph 10.6 of Article 5 and Article 18.1 of the Federal Law "On Advertising", legislation on the protection of competition, when posting advertising information in the Content;
Bring to the public attention all information provided for by advertising legislation about the advertised object, including, but not limited to, age marks, warnings, designation of the persons(s) providing the relevant services.
If the Content meets the criteria established by Blogstars for the number of views of such information and/or other criteria, Blogstars has the right (but is not obligated) to offer the User to enter into a separate agreement aimed at monetizing the Content. Blogstars, at its sole discretion, determines the conditions described above that the User must fulfill in order to enter into such an agreement.
When creating and posting Videos on the Service, the User has the right to use a piece of music (hereinafter referred to as the "Soundtrack"), which is available for these purposes in the "Music" section in the Video editor functionality under the following conditions:
The User has the right to include the Soundtrack or a fragment thereof no longer than 60 seconds in the Videos posted on the Service, i.e. synchronize it with the sound and/or visual sequence of other objects, as well as superimpose an image, text, or other information on the Soundtrack or a fragment thereof to create Videos;
The User has the right to make the Soundtrack or its fragment as part of the Videos publicly available in such a way that any person can access the Soundtrack as part of the Videos;
The User has the right to technically transform the Soundtrack or its fragment in order to place the Video on the Service, namely, to change without limitation the timing (duration) of the Soundtrack or its fragment, the playback speed (acceleration or deceleration), the pitch of the sound, provided that such actions do not distort the meaning and violate the integrity of the perception of the Soundtrack, and do not discredit the honor, dignity and business reputation of the copyright holder of the Soundtrack, Blogstars and / or third parties;
The User has the right to reproduce a unit of the Soundtrack or its fragment as part of the Videos in the memory of the User's devices, computer memory and other technical devices compatible with computer memory, subject to subsequent uploading of the Video to the Service. The device means personal computers (PC), pocket PCs, smartphones, mobile phones, etc. devices that can be used to gain access to the Service.
The User has the right to perform the actions specified in the clause of the Terms solely for the purpose of creating and posting Videos on the Service without making a commercial profit.
Blogstars has the right to suspend the provision of the right to use any Audio Track at any time for any reason. Blogstars does not guarantee the availability of a particular Audio Track, nor does it guarantee its availability on the Service for a certain period. The User is obliged to immediately stop using the Audio Track upon receipt of a corresponding request from Blogstars, as well as upon detection of the absence of the Audio Track in the "Videos" functionality.
The User grants a license to cache the Video, i.e. the right to view Videos saved in the local memory of a mobile device, without access to the Internet and without saving to the User's device exclusively by using the functionality of the Service available through a mobile application for iOS and Android operating systems for the entire period of posting the Video on the Service, in the territory in which the Service is available for use through a mobile application for iOS and Android operating systems, however, some functionality of the Service may not be available in a certain territory. The specified rights to use cached Videos available in the Service are provided exclusively within the framework of the Service for personal non-commercial purposes. In this case, the User has no right to upload, post, publish, make publicly available or otherwise use the Videos cached from the Service on any Internet resource that allows downloading and viewing or listening to video content, with the exception of uploading or posting Videos on Blogstars Resources. Any use by the User of cached Videos not provided for in this paragraph of the Terms is prohibited.
The User has the right to cache Videos unchanged, provided that all copyright signs or other authorship notices are preserved, and the author's name is preserved unchanged.
Blogstars has the right to suspend the right to use any cached Video at any time for any reason. Blogstars does not guarantee the availability of a specific cached Video, nor does it guarantee its availability on the Service for a certain period.
The User shall immediately stop using the cached Video upon receipt of a corresponding request from Blogstars, as well as upon detection of the absence of the cached Video on the Service.
The User shall not have the right to use cached Videos available on the Service outside the Service itself.
When creating and posting Videos on the Service, the User shall have the right to use the audio track from the Videos of other Users. The User shall have the right to post Videos containing audio tracks from the Videos of other Users exclusively on the Service. The User shall not have the right to copy, reproduce, perform, distribute, process, or otherwise use the audio track from the Videos of other Users separately from the Videos and/or as part of any other User information.
When creating and posting Videos on the Service, the User agrees that any other User shall have the right to use the audio track from such Videos to create their own Videos. From the moment the Video is posted on the Service, the User grants to all Users of the Service a simple (non-exclusive), royalty-free and irrevocable license to use the audio track from the Video, including by reproducing, copying, processing, including it in a complex object — the Video of another User, and further use in a complex object. The User grants a license to use the audio track from the Video for the entire period of posting the Video on the Service and agrees that other Users using the audio track from their Video also have the right to grant a similar license (sublicense) to use such audio track in the Videos of other Users.
The Service has the right to automatically generate Collections of channels and posts on various topics in the "Topics" section (or another similar section in meaning), as well as automatically generate separate Metachannels that combine Content on specialized topics. The content of the Metachannel is formed on the basis of key queries of Users and has an interface that is different from the channels of the Users themselves. The Metachannel combines Content of different formats in the corresponding sections established by Blogstars. Content can be ranked by the date of its posting, as well as depending on the popularity of the Content. Blogstars is not responsible for the content of the Content included in Collections and Metachannels, and cannot guarantee that the Content does not violate the provisions of the Terms and applicable law. Responsibility for the content of the posted Content included in the Collection and/or Metachannel lies with the User who posted the relevant Content on the Service.
Rights and Obligations of the Parties
6.1. Blogstars does not guarantee and does not bear any responsibility for the continuity and uninterrupted availability of the Service. The User understands that the availability of the Service largely depends on the Internet connection, computer, mobile phone or other devices of the User, as well as on the tariff chosen by the User for access to the Internet.
The User undertakes to use the Service solely for the purposes specified in the Terms.
The User has no right to perform actions that may lead to a violation or failure in the operation of the Service, as well as any actions aimed at circumventing the restrictions established by the Service, including actions aimed at increasing the number of views of the Content, including the use of any automatic methods of reproducing impressions and clicks (multiple clicks, use of agent programs, etc.), but not limited to the above. If the User interferes with the normal functioning of the Service, Blogstars is not responsible for any failures in the operation of the Service caused by such interference.
The User is solely responsible for compliance with any applicable laws when using the Service, including both the laws of the Russian Federation and the laws of the User's place of residence or the place where he/she performs legally significant actions in accordance with the Terms. If the User's use of any feature provided by the Service violates applicable laws, the User undertakes to refrain from using the Service.
Blogstars may provide the Service under the name "Blogstars" or under any other name that may change from time to time. Regardless of the name under which the User was granted access to the Service, the User has no right to change and/or remove the name of the Service (if possible), copyright marks and other intellectual property rights, as well as any other references to Blogstars and/or its partners.
If the User accesses the Service using the services or software of third-party partners of Blogstars that allow access to the Service or its functions, such third-party partners of Blogstars may provide additional services and/or functions for the User. The User understands and agrees that the terms of use of such third-party services and/or features are determined by Blogstars partners, and the User undertakes to review and accept such terms before using such services and/or features. In any such case, the User enters into a binding relationship with the relevant Blogstars partner, and not with Blogstars. Blogstars does not warrant and shall not be liable to the User in connection with the use of such additional services and/or features, including for their content and/or any information available through them.
The User acknowledges and agrees that all copyrights, patent rights, trademark rights, rights in trade secrets and other intellectual property rights in the Service belong to Blogstars and/or other rights holders. For the avoidance of doubt, by using the Service, the User does not acquire any rights in Blogstars' intellectual property, except for the rights to use such intellectual property, which are the minimum necessary for the User to use the Service in accordance with the Terms.
